Draft for legal review. These terms are not in effect yet.
Acceptable Use Policy
This Acceptable Use Policy is part of Basemodo's Terms of Service. It applies to you, to your Apps, to your Agents, and to everyone you let deploy or use your Apps. Words with capitals mean what the Terms define. Breaking this policy, or helping or letting someone else break it, may lead to the actions in Section 6 of the Terms, from slowing an App down to terminating your account, and we may report illegal activity to the authorities.
1. Illegal and harmful content
You may not use the Service to store, publish, send or link to content that:
- sexually exploits or endangers children in any way, including child sexual abuse material, which we report to the National Center for Missing and Exploited Children;
- is sexual or intimate content of a person shared without their consent;
- promotes, threatens or incites violence or terrorism, or harasses, bullies, threatens or doxxes anyone;
- infringes anyone's copyright, trademark, privacy, publicity or other rights;
- is fraudulent, deceptive or misleading, including phishing pages, fake login pages, scams, fake shops, impersonation of a person or an organization, and pages that trick people into paying or into giving their credentials;
- sells or facilitates the sale of illegal goods or services, including controlled drugs, weapons, stolen data, counterfeit goods;
- runs, takes part in or advertises betting or gambling of any kind, licensed or not; or
- violates any law that applies to you, to your Visitors or to Basemodo.
2. Attacks, malware and network abuse
You may not use the Service, or let an App be used, to:
- distribute malware, ransomware, spyware, exploit kits or any code meant to harm or take over a system;
- run or control a botnet, a command-and-control server, a credential-stuffing or brute-force tool, or a denial-of-service attack of any size;
- scan, probe or test for vulnerabilities in any network or system you do not own or have written permission to test, or break or get around any authentication or security measure;
- send email, unless through a provider's API that you are allowed to use, and never send spam: unsolicited bulk messages of any kind, by email, SMS, chat or comment forms;
- run an open proxy, a VPN or Tor exit or relay, a public relay of any kind, a peer-to-peer file-sharing client, or anything that lets others send traffic through Basemodo's addresses;
- mine cryptocurrency, or run proof-of-work, proof-of-space or similar computation, in any amount and for any reason;
- crawl or scrape websites in breach of their terms or their robots.txt, or at a rate that burdens them; or
- reach, or try to reach, Basemodo's own networks and internal services, another customer's Machines, or the providers' metadata services.
3. Abusing the platform
You may not:
- create several accounts, or use someone else's, to get more Trials, avoid Quotas or Plans, or come back after a suspension;
- get around, or try to get around, Quotas, rate limits, the network policy, the sleep of Apps, or any other limit of the Service, including by splitting one workload across many Apps or accounts;
- use the Service mainly as file storage, a backup service, a content delivery network, a video or large-file host, or a mail server;
- resell, rent or offer the Service to others as hosting, or run Apps for third parties as a hosting provider, without our written agreement;
- attack, overload, reverse engineer or interfere with the Service, the gate in front of every App, the CLI or the MCP, or try to read data you are not allowed to see;
- collect personal data of Visitors or anyone else without a lawful basis and the notice the law requires, or collect it to sell, track or profile people without their consent; or
- use the Service for high-risk activities where a failure could cause death, injury or severe damage, or to store regulated data (payment card numbers, regulated health records) unless we agreed in writing.
4. Agents
Everything in this policy applies to what your Agents deploy and do. You may not instruct, configure or allow an Agent to do anything this policy forbids, and you are responsible for an Agent that does it on its own.
5. How Basemodo detects abuse
To keep the Service and the internet safe, Basemodo measures, for every App: the requests it receives, how much it sends out and to how many hosts, how often its connections fail and toward which hosts, the domain names it looks up, and how busy its CPU is. We compare each App with its own recent usage and with fixed thresholds, and look for the same target across many accounts. We keep these measures for 30 days to investigate. When an App's usage looks like abuse, we act automatically, as Section 6 of the Terms describes:
| What we see | What happens |
|---|---|
| An App sends out more than its Plan's daily limit, or receives a flood of requests | Its traffic is slowed down for a while, and its Owner is told |
| A sudden spike of outbound traffic, connections to a very large number of hosts, a burst of failed connections to one host, a CPU kept busy for hours in an App with no worker, or code already found abusive | The App is paused and reviewed; its Owner is told why |
| A lookup of a domain on our blocklist of mining pools and command-and-control servers, or Apps of several accounts attacking the same host | The account is suspended until a person at Basemodo reviews it |
During a Trial and the first days of a paid account, the limits are lower and the first review suspends the account. Every automatic action can be reversed by a person at Basemodo, and the Owner sees it in the Service.
6. Reporting abuse
Report an App that breaks this policy to abuse@basemodo.com, with its address and what you saw. For copyright, follow Section 12 of the Terms and write tocopyright@basemodo.com. We look at every report, may act without telling the reporter the outcome, and never tell the Owner who reported them unless the law requires it.
We may change this policy as new kinds of abuse appear. Changes that address abuse take effect when they are published here.
